Discussion about legalizing same sex marriage started a long time ago.  People have created their own opinions about this topic based upon their perception. People in different places are probably going to have different opinions. It is not the same opinion in Iran like it is in The Netherlands. It all has to do with your level of education, the place where you live and other factors which are going to create your opinion about same sex marriage. While there are a lot of pros and contras regarding this topic, gay marriage should be legalized.

Gay marriage should be legalized because everybody has a right to create a family. In every document about human rights it is written that creating a family is the basic right for every person, no matter of sex, color and education. It always has been like that. Marriage is between two human creatures and no one else.  However, the opponents of same sex marriage consider the right to create family exists only for heterosexual people.  They consider that marriage is between one male and one female. For them same sex marriage is something new and doesn’t deserve to be called marriage. For example, how is it possible that two persons of the same sex to create family. As we all know, two males or two females can’t have babies. Anyway this is not a strong argument for homosexuals.  Homosexuals are always ready to say that they have love of each other and if they want a child they will adopt one.  For the opinion of many people the adoption of children should be allowed only for heterosexual couples. How is it possible that one child can have two fathers or two mothers?  Every child in the world deserves to have one mother and one father who takes care of them. However gay people would say that every child deserves to have two parents who love them. The sex of the parents should not matter. Two males or two females can take care of a child as well as heterosexual couples, if not better. There are no data to suggest that two children who have gay or lesbian parents are different in any aspects of psychological, social and sexual development form children in heterosexual families (Pediatrics).¹

Gay marriage should be legalized because equality under law requires the same treatment for everybody.   All people have the right to get married.  If the law refuses somebody’s right that is discrimination. The Constitution of The Republic of Kosovo clearly states that everyone is equal before a law. However, even though it appears Kosovo allows same sex marriage, till now this has been a taboo topic.  Generally, no one wants to tell if Kosovo’s Constitution really allows same sex marriage.  In reality is an equality in words only.

Article 24 of the Constitution of the Republic of Kosovo states:

1.      All are equal before the law. Everyone enjoys the right to equal legal protection

without discrimination.

2.   No one shall be discriminated against on grounds of race, color, gender, language,

religion, political or other opinion, national or social origin, relation to any community, property, economic and social condition, sexual orientation, birth, disability or other personal status. (Constitution of Kosovo).²

However, it is not necessary that the law to treat everybody in same way. Does the law 

treat in same way criminals and people who obey the law; children and adults or citizens and illegal aliens?  The constitutions of some states are very old so there is no space for new things like same sex marriage. In many constitutions marriage is defined only for heterosexual people.  Many states are not willing to change their constitutions.  They consider that if they change the constitution this is going to offend many people.  Allowing same sex marriage may offend  many groups of people. France, a country that is known for being liberal, has cancelled the first gay marriage. It was declared illegal by France's highest court recently (BBC).³

            Why does religion have to be against gay people?  Gay people believe God created them to be homosexual and God wants them to be happy.  It is not written in any religious book that God is against love. God taught us that we should love each other.  However, religious leaders from most religions are against gay marriages. In fact for most of them being gay is categorized as one of the biggest sin that one humane creature can do.  Pope Benedict XVI, is one of the biggest enemies of gay marriages.

            In my opinion gay marriages should be legalized. Every person has the right to create a family. Being gay should not prevent you from having the same right as heterosexuals.  The law should treat people in same way. If I want to get married with a man then nobody has the right to tell me I cannot. It is personal choice with whom you are going to spend your life. Where there  is love, there is God.

            Considering that family is a basic human right and no religious arguments contradict that

right, therefore same sex marriage should be legalized.
